Lomari
Terms of Use
These Terms of Use govern the use of the Lomari app and the related services (together, “Lomari”) provided by VML Development GmbH, Rugenbarg 35j, 22549 Hamburg, Germany (“we”). By installing or using Lomari you agree to these terms. Statutory consumer rights are not restricted by these terms.
1. What Lomari is
Lomari lets a family create a private space, invite parents and children with a code, share the latest known location of devices whose owners have enabled sharing, define places and safe zones, exchange messages and send alarms. Lomari is a convenience and coordination tool. It is not an emergency service and does not replace calling the local emergency number.
2. Eligibility and accounts
Parents and other adults need an Apple ID and must be at least 18 years old or have reached the age of majority in their country. Children join a family space only through an invite code created by a parent. By creating a child invite, the parent confirms to be that child’s parent or legal guardian and to have the authority to consent to the processing described in the privacy policy. Where the law requires it, verifiable parental consent is collected before a child can join.
3. Consent and acceptable use
You may only use Lomari to locate people who have consented on their own device, or minors for whom you are the parent or legal guardian. Covert tracking, tracking of adults without their ongoing consent, and any use that violates applicable law or the rights of others is prohibited. Location sharing is always visible on the shared device and can be switched off there at any time. You must not attempt to circumvent these transparency measures, interfere with the service, or use it to harass or endanger anyone.
4. Free features and Lomari Plus
The safety features of Lomari (latest location with automatic updates, manual refresh, SOS and alarms, messages, device status and a limited number of safe zones) are free of charge. Lomari Plus is an optional auto-renewable subscription that adds convenience features such as scheduled Live windows, longer Live sessions, more safe zones, reliability checks, widgets and Shortcuts. The current price and duration are shown in the App Store before you subscribe.
5. Subscription terms
Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel it in your Apple ID settings (Settings → your name → Subscriptions). If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Refunds are handled by Apple in accordance with its terms. Where a subscription is bought for a family space, the benefits apply to the members of that space while the subscription is active. Prices may change for future periods; you will be informed in advance through the App Store and may cancel before the change takes effect.
6. Availability and limits
Lomari depends on Apple’s iOS, the Apple Push Notification service, the Location Push Service, network connectivity, battery state and the permissions granted on each device. Background updates are scheduled by iOS and cannot be guaranteed at fixed intervals. We therefore cannot guarantee that a location, message or alarm is delivered, delivered on time, or accurate. If someone may be in immediate danger, call local emergency services first.
7. Privacy
How we process personal data, how long we keep it and which rights you have is described in the privacy policy. We do not sell location data and do not show advertising.
8. Your content
Messages and names you enter remain yours. You grant us the right to store and transmit them solely to provide the service to the members of your family space. You are responsible for the content you share.
9. Termination and deletion
You can delete your account at any time in the app (Settings → Leave family or delete account); this removes your membership, devices, last known position, zones, messages and tokens. Parents can remove a child’s device. We may suspend or terminate access if these terms are violated, in particular in cases of covert tracking or abuse; where possible we will inform you beforehand. Deleting the app does not cancel an active subscription; cancel it in your Apple ID settings.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for the breach of essential contractual obligations and only for the foreseeable damage typical for this kind of contract. Any further liability is excluded. Lomari is not designed for situations in which a failure could cause injury or death; you must not rely on it in such situations.
11. Changes to these terms
We may update these terms when the service or the law changes. You will be informed in the app or by other appropriate means before material changes take effect; continued use after that date constitutes acceptance. The current version is always available at https://lomari.app/terms.
12. Governing law and venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer-protection provisions of your country of residence remain unaffected. For merchants, the courts of Hamburg have exclusive jurisdiction.
13. Apple
These terms are concluded between you and us, not with Apple. Apple is not responsible for Lomari or its content and has no obligation to provide maintenance or support. In case of a failure to conform to an applicable warranty you may notify Apple, which will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation. We, not Apple, are responsible for addressing claims relating to Lomari, including product liability, legal compliance and consumer protection claims, and for the investigation, defence and settlement of any third-party claim that Lomari infringes intellectual property rights. You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s standard licensed application end user license agreement applies where these terms are silent.
